About the EB-5 Program

  • The EB-5 Immigrant Investor Program, administered by the U.S. Citizenship and Immigration Services (USCIS), enables eligible foreign investors to seek U.S. permanent residency through qualifying job-creating investments.
  • To participate, investors must invest a minimum amount of capital -currently $800,000 in a Targeted Employment Area (TEA) or certain infrastructure projects, or $1,050,000 in other areas - and demonstrate that their investment creates or preserves at least 10 full-time U.S. jobs for qualified workers.
  • EB-5 investment structures typically operate through a New Commercial Enterprise (NCE) that deploys funds into a Job-Creating Entity (JCE) such as a real estate or operating business.
    The EB-5 Reform and Integrity Act of 2022 reauthorized the program and introduced enhanced oversight and compliance measures.

  • Project Selection
    The investor selects a qualified EB-5 project, often through a regional center or investment manager, and completes due diligence.
  • Filing of the I-526E Petition
    The investor’s immigration attorney files the petition to establish that the investment funds are lawfully sourced and at risk, and that the project plan meets EB-5 requirements.
  • Conditional Permanent Residency
    Upon USCIS approval, the investor and qualifying family members may receive a conditional two-year green card.
  • Sustainment and Job Creation
    The investment must remain active during the sustainment period while the project creates or preserves the required jobs.
  • I-829 Petition and Permanent Residency
    When job-creation targets are met and the sustainment period is satisfied, investors can apply to remove conditions and obtain permanent residency.
